This Invitation for Tenders follows the General Procurement Notice for this project which was published on the EBRD Web Site, Procurement Opportunities on 26 April 2010.

Lviv Municipal Enterprise "LVIVELEKTROTRANS", the Employer has received a loan from the European Bank for Reconstruction and Development (the Bank) towards the cost of the Lviv Public Transport Project.

The Employer now invites sealed tenders from Contractors for the following contract to be funded from part of the proceeds of the loan:

• Supply and Installation of electric equipment for the modernisation of the 19 traction substations and the control centre for the power supply of the electric city transport (tramways and trolleybuses) of Lviv.

Equipment includes 6kV switchgear (full or partial replacement), 600V switchgear (full or partial replacement), and power supply SCADA. Supply of equipment and installation and commissioning on the 19 substation sites and the control centre site shall extend over duration of 18 months after signature of the contract.

To be qualified for the award of a contract, tenderers must satisfy the following minimum criteria:

1. Historical non-performance. A consistent history of historical non-performance and/or litigation awards against the tenderer or any partner of a joint venture may result in rejection of the tender.

2. Financial situation

2.1. Historical financial performance

The audited balance sheets for the last Three years shall be submitted and must demonstrate the soundness of the tenderer's financial position, showing long-term profitability. Where necessary, the Purchaser will make inquiries with the tenderer's bankers.

2.2. Average annual turnover

Average annual turnover as single Contractor or combined average annual turnover as Joint venture, Consortium or Association over the last three years of EURO 8 million equivalent.

2.3. Financial resources

The tenderer (single entity, joint venture, consortium or association) shall demonstrate that it has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means sufficient to meet the production cash flow for the contract estimated as not less than EURO 5 million equivalent per year, taking into account the tenderer's commitments for other contracts.

3. Experience. Experience as Contractor, in at least three contracts within the last five years, each with a value of at least 50% of the estimated cost of the contract, that have been successfully and substantially completed and that are similar to the proposed one. The similarity shall be based on the physical size, complexity, methods/technology or other characteristics as described in Volume III, The Requirements.

4. Personnel. The tenderer shall provide suitably qualified personnel to fill particularly the position of Commissioning and Tests Officer with minimum 10 years total work similar experience and 5 years similar works experience.

A Joint Venture, Consortium or Association may be also qualified with the condition that each member meets 40% of the conditions and that at least one member meets 60% of the criteria.

Tendering for contracts to be financed with the proceeds of a loan from the Bank is open to firms from all countries. The proceeds of the Bank's loan will not be used for the purpose of any payment to persons or entities, or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations.

Upon receiving appropriate evidence of payment of the non-refundable fee, the documents will be promptly dispatched by courier; however, no liability can be accepted for loss or late delivery. If requested the documents can also be dispatched electronically after the presentation by the prospective tenderer of appropriate evidence of payment of the non-refundable fee. In the event of discrepancy between electronic and hard copies of the documents, the hard copy shall prevail.

All tenders must be accompanied by a Tender Security of Euro 150 000, and must be delivered to the address below on or before 24/05/2011 at 10:00am Lviv time, at which time they will be opened in the presence of the tenderers' representatives who wish to attend.
