This Invitation for Tenders follows the General Procurement Notice for this project which was published in Procurement Opportunities on the EBRD website 20 July 2009.

Cherkasy Municipal Enterprise of District Heating Networks "Cherkasyteplokomunenergo" (the Employer) has received a loan from The European Bank for Reconstruction and Development (the Bank) towards the cost of Cherkasy Energy Efficiency Project.

The Employer now invites sealed tenders from Contractors for the following contract "REHABILITATION OF BOILER PLANT No.17" to be funded from part of the proceeds of the loan:

Contractor is supposed to supply, install and put into operation the following equipment in two boilers plants under rehabilitation:

- Three-pass fire-tube hot water boiler units, capacity 12 MW and efficiency not less than 96 %, with associated equipment;

- Distribution pumps, capacity 220 m3/h, head 50 m, temperature 120 °C, with frequency converters and accessories;

- ВFW pump, capacity 2,5-4,8 m3/h, head 45-50m, temperature 0...90°C;

- Water treatment and chemical deaerator systems, capacity 15 m3/h;

- Auxiliary equipment.

Contractor will have to implement design, supply, installation, precommissioning and commissioning of the equipment under the Contract and train the operational personnel of the Employer.

The tenderer will be required to meet the following minimum criteria, as specified in Tender documents:

a) The Tenderer shall have successful experience as prime contractor in the execution of at least 2 completed projects in supply and installation of the similar type of equipment in boiler plants for rehabilitation with the plant's capacity not less than 30 MW and preferably in the district heating within the last 5 years.

b) The Tenderer or its agent will be able to carry out the supplier's maintenance, warranty, repair and spare parts stocking obligations prescribed in these Tender documents as well as servicing of all the equipment included in scope of supply. The Tenderer shall give details of local service agent or state how these obligations will be met in the event of a contract.

c) The Tenderer has long-term profitability with positive average annual operating profit in the last three years.

d) The average annual turnover over the last five years is not less than Euro 2,5 million or equivalent.

e) The Tenderer must have financial capability to meet the construction cash flow for the contract for a period of 3 months, estimated as minimum Euro 300 000 (three hundred thousand) or equivalent taking into account the Tenderer's commitments on other contracts.

f) The Tenderer has a Litigation History without major claims. A consistent history of awards against the Tenderer or any partner of a joint venture may result in failure of the application.

g) The tenderer shall provide suitably qualified personnel to fill the following positions: Contractor representative (not less than 15 years of total experience, 5 years of experience in similar works and 3 years of experience as manager of similar works), Design Manager (not less than 10 years of total experience, 5 years of experience in similar works and 3 years of experience as manager of similar works) and Construction Manager (no less than 10 years of total experience, 5 years of experience in similar works and 3 years of experience as manager of similar works).

h) Joint ventures must satisfy the following minimum qualification requirements:

1) The leading partner shall meet not less than 40 percent of all the qualifying criteria for turnover and financial position specified above;

2) The other partners shall meet not less than 25 percent of all the qualifying criteria for turnover and financial position specified above;

i) The joint venture must satisfy collectively the criteria related to personnel and equipment capabilities and financial position stated above.

The Contract is planned to be completed within 7 months from the effective date.

Tendering for contracts to be financed with the proceeds of loan from the Bank is open to firms from all countries. The proceeds of the Bank's loan will not be used for the purpose of any payment to persons or entities, or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations.

All tenders must be accompanied with a Tender Security in the amount of Euro 20,000 (twenty thousand) or equivalent in Ukrainian Hryvna at the rate of the National Bank of Ukraine on the date of the Tender Security issue, and must be delivered to the address below on or before 10:00am, 5 July 2011, when they will be opened in the presence of the tenderers' representatives who wish to attend.
